Estelle AB – Terms of sale

General

These terms of sale ("Terms") apply for all purchases of products from Estelle AB ("Estelle ", "we", "our", "us") through our online store at www.estelle.com (“Store”). By placing an order with us, you (“customer”, “you”, or “your”) confirm that you have understood the Terms and that you agree to be bound by the Terms in connection with your orders placed and purchases made in the Store.

To place orders with us you must be at least 18 years old.

Please read the Terms thoroughly before placing any orders. If you do not agree to the Terms, you may not place orders with us.

Provisions on amendments to the Terms are set out in section 16 below.

Prices and product information

The features and nature of our products are described in the information available in the Store along with any additional information that may be provided when you place your order.

Current prices for our products are available in the Store and are stated in Swedish kronor (SEK) and include 25% VAT. Prices are exclusive of shipping fees unless otherwise stated (shipping fees are always presented at checkout before you place an order).  

We do our utmost to ensure that product and price information is correctly stated in the Store. We reserve the right to correct any inaccuracies at any time, such as incorrect specifications or prices, and we disclaim all liability for such inaccuracies. In the event of obviously incorrectly priced products, we reserve the right to cancel your order.

All prices are valid until further notice. We reserve the right to change prices without prior notice. However, for products that you have ordered from us, the price stated at checkout and in our delivery confirmation always applies.

Orders

To place an order with us you must be at least 18 years old and accept these Terms.

When you place an order in the Store, you need to enter your contact details and delivery address. Before you complete your order, we will present the full price of the products you are ordering and any delivery fees. Once you have selected a payment method and clicked on "Pay for purchase", the order becomes binding on you.

When you have placed an order, you will first receive a non-binding order confirmation from us.

Only after you receive a delivery confirmation from us will we have accepted your order, the order becomes binding on us. If there is an error in an order confirmation, or a delivery confirmation, you must contact us without delay at support@estelle.com.

Payment

Payment for the products you have ordered is made by card payment in the Shop in accordance with the terms and conditions of the respective payment service provider.

Delivery

Delivery is made in the way you choose in the Store at checkout when you place your order. If possible, will inform about estimated delivery time at checkout. Products ordered that are not in stock may be subject to longer delivery times but will be delivered as soon as possible.

If delivery is made by picking up at a delivery point, you will normally be notified the carrier. For more information about each carrier's terms and conditions, such as how long your package remains at a collection point, please refer to the respective carrier.

Unredeemed shipments

If the package is not picked up within the times specified by the carrier, it will be returned to Estelle. If you do not pick up the package before it is returned to us, you will be charged a handling fee of 200 SEK. This fee includes costs for shipping, return shipping, administration, and handling. The remaining order value will be refunded to you via the payment method used for the purchase. If, after ordering, you want to use your right of withdrawal (as provided for in section 8 below) and do not want to be charged with the handling fee, you need to pick up the package at your agent and return it to us.

Shipping damages

It is the customer's responsibility to check the delivery upon receipt. If a product appears damaged due to damaged packaging, always unpack and check the product itself. In the event of transport damage (physical damage to the product), you must immediately contact the carrier to claim the goods. Then contact Estelle via support@estelle.com and provide the order or invoice number and complaint number from the carrier.

Right of withdrawal (consumers only)

When you buy products from our Store as a consumer, the right of withdrawal applies according to the Distance Contracts Act, which means that you have the right to withdraw from the purchase without giving any reason within 14 days from your receipt of the products.

To exercise your right of withdrawal, you must send a clear and unequivocal notice of your decision to withdraw from the contract to: Estelle AB Sveavägen 124 113 50 Stockholm Sweden, Email: support@estelle.com

If you prefer, you can use this withdrawal form to exercise the right of withdrawal, but it is not a requirement: www.estelle.com/withdrawal-form.

Once we have received your withdrawal notice, we will provide you with further information on how to return the products and how the refund will be made.

If you withdraw from your purchase and return the products, we will, subject to the Terms, reimburse all the payments we have received from you, including delivery costs (but not additional delivery costs resulting from you choosing a delivery method other than the cheapest standard delivery we offer). The refund will be made without undue delay and no later than 14 days from the day we were informed of your decision to withdraw from the purchase. We may however withhold the refund until we receive the products back from you or until you send us proof that you have returned the products, whichever comes first.

We will use the same means of payment for the refund as you used for the purchase, unless you have expressly agreed with us otherwise. In any case, the refund will not cost you anything.  

You will have to pay the direct costs of returning the products if you do not choose to return the products to one of our shops.

When exercising your withdrawal rights, you liable for potential reduced value of the products only as a result of handling other than what is necessary for you to establish the nature, characteristics and functioning of the products. We reserve the right to make a deduction from the amount to be reimbursed for any reduction in value (up to 100% of the value) caused by your handling of the products other than what is necessary or if the products are otherwise not in an essentially unchanged condition when returned. We advise you not to use the products until you have decided that you want to keep them. We also recommend that, where appropriate, you leave protection such as protective plastic film and the like in place. Furthermore, we ask you to send the products in its original packaging and together with any accessories.

Product warranty

Estelle provides a 2-year factory warranty on all products unless otherwise stated. The warranty means that we replace or repair defect products within 2 years if the product is not damaged by handling errors.  

If you want to invoke the factory warranty, please contact at support@estelle.com for detailed return information. We are covering your return shipping costs as long as you use our designated shipping option. If your product arrives in a visibly damaged condition, we reserve the right to refuse to accept receipt.

The usual procedure for warranty claims is free repair. If repair is considered unreasonable, the product may be replaced by another product with equivalent function/performance.

If no defect is found, an investigation fee and return shipping may be charged to you.

For repaired parts, spare parts and replacement products, no new warranty period applies. The warranty period always expires at the latest as stated above.  
The warranty does not affect your rights as a consumer under mandatory legislation.

3-year right of complaint (consumers only)

The following applies if you have purchased products from us as a consumer.

Defective products must be complained about within a reasonable time from when the defect was noticed or should have been noticed. Complaining within two months always counts as within a reasonable time.

The complaint period is a maximum of 3 years from the time you received the product. After this deadline has expired, you can no longer make a claim for defects in the product.

If you wish to submit a complaint to us, always contact us at support@estelle.com so that we can remedy the defect in the best possible way. If the defect cannot be resolved other than by returning the product, a return shipping label will be sent with prepaid shipping. If no defect is found, an investigation fee and return shipping may be charged to you.

Liability for defects and limitation of liability

Our liability due to defects in products is limited to what is stated in these Terms and in relation to consumers to what is stated in the Consumer Purchase Act and other consumer legislation.

If you have purchased a product as a consumer and the defect is of significant importance and cannot be remedied or if delivery cannot be made, you have the right to cancel the purchase. If the purchase is canceled, the purchase amount will be refunded as soon as possible, but no later than 30 days after we received the products.

If the buyer is not a consumer, our liability for damage due to product defects or delivery delays is limited to the purchase price of the product. We are not liable for indirect losses such as loss of profits or other similar losses that were difficult to foresee, unless it can be shown that we acted with gross negligence or intent. Claims for damages must be made within six months after the event giving rise to the claim has occurred. As far as consumers are concerned, we are not liable for business losses.  

The limitations provided for in this section 11 do not affect your statutory rights as a consumer.

Force majeure

Estelle is not liable for damage resulting from strikes, fire, exercise of public authority, labor disputes, accidents, errors or delays by subcontractors, downtime or disruptions in public communication systems or other circumstances beyond our control and which we cannot reasonably be expected to count on and whose consequences we could not reasonably avoid or overcome. If force majeure in accordance with this provision persists for a period exceeding 2 months, both your and Estelle have the right to cancel the agreement regarding the order and delivery of products, without any penalties or sanctions.

Information on the Terms and language

You have the right to receive the Terms in legible and durable form upon request. The Terms will be sent to you by email if you so wish. The Terms as well as other legal information is provided to you in the English language.

Consumer rights

The Terms do not exclude, limit or otherwise restrict the rights vested with consumers under applicable consumer law and shall not be construed as such.

Amendment to the terms

We reserve the right to make changes to the Terms at any time. Changes to the Terms are published online and available in the Store. Please note that when ordering, you are bound by the Terms accepted by you at the time of your order. We recommend that you always read the Terms carefully before placing an order with us.

Governing law

The Terms shall be governed by the substantive law of Sweden and shall be finally settled by the courts of Sweden.

In the event of a dispute with Estelle, you have the option of having the matter tried out of court by the Swedish National Board for Consumer Disputes (ARN).
